You agree to pay all applicable fees as disclosed in your loan agreement or service documentation. Late payments may incur penalties.

6. User Conduct

You agree not to:

  • Use our services for illegal or fraudulent purposes

  • Impersonate another person or entity

  • Interfere with platform functionality or security

7. Intellectual Property

All content, trademarks, and technology on our platform are owned by GPD Fund or its licensors. You may not reproduce, distribute, or modify any part without written permission.

8. Privacy and Data Use

Your personal data is handled according to our Privacy Policy. We may share data with third parties for service delivery, compliance, or fraud prevention.

9. Disclaimers

Our services are provided “as is” without warranties of any kind. We do not guarantee loan approval, uninterrupted access, or error-free operation.

10. Limitation of Liability

GPD Fund is not liable for indirect, incidental, or consequential damages arising from your use of our services, except as required by law.

We may suspend or terminate your access at any time for breach of these Terms or legal violations. You may also close your account by contacting support.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada.

Disputes will be resolved through arbitration or mediation in Ottawa, Ontario, unless otherwise required by law.

GPD Fund LP is committed to preventing money laundering, terrorist financing, and financial crimes. This Anti-Money Laundering (AML) and Know Your Customer (KYC) Policy outlines our compliance framework under Canadian law, including the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA) and guidance from FINTRAC.

1. Objectives

  • Prevent misuse of our financial services for illicit activities

  • Identify and verify customers accurately

  • Monitor transactions for suspicious behavior

  • Report to regulatory authorities as required

2. Customer Due Diligence (CDD)

We perform CDD on all clients before onboarding. This includes:

  • Identity verification using government-issued ID

  • Address confirmation

  • Employment and income verification

  • Screening against sanctions and watchlists

3. Enhanced Due Diligence (EDD)

EDD is applied to high-risk customers, including:

  • Politically exposed persons (PEPs)

  • Non-residents or offshore entities

  • Clients with complex ownership structures

4. Ongoing Monitoring

We continuously monitor:

  • Transaction patterns and volumes

  • Unusual or inconsistent activity

  • Changes in customer profile or behavior

5. Record Keeping

We retain:

  • Identity documents and verification records

  • Transaction logs and communications

  • Suspicious activity reports (SARs)

Records are kept for a minimum of five years, as required by law.

6. Reporting Obligations

We report:

  • Large cash transactions over CAD $10,000

  • Suspicious transactions regardless of amount

  • Terrorist property reports

Reports are submitted to FINTRAC in accordance with regulatory timelines.

7. Staff Training

All employees receive regular AML/KYC training covering:

  • Legal obligations

  • Risk indicators

  • Reporting procedures

8. Risk Assessment

We maintain a risk-based approach to customer onboarding and transaction monitoring. Risk levels are reviewed periodically.

9. Third-Party Relationships

We ensure that third-party service providers comply with equivalent AML/KYC standards. Contracts include data protection and reporting clauses.

10. Policy Review

This policy is reviewed annually or as required by regulatory changes.
